These terms form a binding agreement between you and LOCAL Gardendale. If you do not agree, please do not use the Site.

1. Acceptance and eligibility
By accessing or using localgardendale.com (the “Site”) you agree to these Terms of Use, our Privacy Policy, and our Legal & Disclaimer notices, which are incorporated here by reference. The Site is intended for users 13 years or older. If you are under 18, you may use the Site only with the involvement of a parent or guardian.
2. License and acceptable use
We grant you a limited, revocable, non-exclusive, non-transferable license to view the Site for personal, non-commercial use. You agree not to:
- scrape, crawl, harvest, or bulk-copy content except as permitted by our robots.txt;
- republish, resell, or create derivative databases from Site content without permission;
- interfere with, overload, probe, or attempt to gain unauthorized access to the Site;
- use the Site or Garden AI for unlawful, harassing, defamatory, infringing, deceptive, or harmful purposes;
- misrepresent your identity or submit false, spam, or malicious content through our forms.
3. Garden AI assistant
Garden AI is an automated assistant powered by third-party models. Output is generated automatically, is not human-reviewed, may be inaccurate or fabricated, and is provided for general information only. Do not submit sensitive personal, health, financial, or confidential information. You are responsible for independently verifying any output before relying on it, and we disclaim all liability for actions taken based on it.
4. Your submissions
When you send us a message through the contact form or submit any suggestion, correction, or content, you represent that it is accurate, lawful, and yours to send, and you grant us a worldwide, royalty-free, perpetual license to use it to operate and improve the Site. Do not send confidential information; we treat unsolicited ideas as non-confidential.
5. Intellectual property
The Site’s original text, design, layout, graphics, and code are owned by LOCAL Gardendale and protected by copyright and other laws. Third-party names, logos, and marks belong to their owners and are used descriptively only.
6. Availability and changes
The Site is provided “as is” and “as available.” We may modify, suspend, or discontinue any part of it — including Garden AI, maps, and weather features — at any time without notice or liability. We may also revise these Terms; continued use after changes means you accept them.
7. Disclaimers and limitation of liability
The disclaimers, assumption of risk, limitation of liability (capped at US $100), and indemnification provisions in our Legal & Disclaimer page apply fully to these Terms and are a material part of this agreement.
8. Termination
We may block access to the Site at our discretion, for any reason, without notice. Sections that by their nature should survive termination — including intellectual property, disclaimers, liability limits, indemnification, and governing law — will survive.
9. Governing law and disputes
These Terms are governed by Alabama law without regard to conflict-of-law principles. You and LOCAL Gardendale agree to first attempt to resolve any dispute informally through our contact form for at least 30 days. Unresolved disputes will be brought exclusively in the state or federal courts located in Jefferson County, Alabama. Each party waives any right to participate in a class or representative action to the extent permitted by law.
